Erie County Court of Common Pleas Overview

Pennsylvania Courts of Common Pleas are the trial courts of general jurisdiction. In Erie County, Common Pleas handles major criminal prosecutions, civil lawsuits, family matters, juvenile proceedings, Orphans' Court matters, and appeals from Magisterial District Judge decisions when state procedure allows appeal.

Erie County is Pennsylvania's Sixth Judicial District. The courthouse and court administration are based at 140 West Sixth Street in Erie, where the Court of Common Pleas, Clerk of Records divisions, jury office, and court administration share the central downtown court location.

Erie County Court of Common Pleas Offices

The Court of Common Pleas is one county trial court with different divisions and records offices rather than a set of separately numbered county courts. The Prothonotary handles civil records, the Clerk of Courts handles criminal records, and Orphans' Court and Register of Wills functions handle estate, guardianship, adoption, and related filings.

Court of Common Pleas vs. Magisterial District Court

Pennsylvania does not use the same county-court and justice-court structure found in some other states. Erie County's local trial structure is Common Pleas for general jurisdiction and Magisterial District Courts for preliminary criminal, traffic, summary, landlord-tenant, and lower-value civil work. Municipal ordinance records may remain with local municipal channels when they are not filed as court cases.

How a Case Moves Through the Erie County System

Criminal matters often begin in Magisterial District Court with an arrest, preliminary arraignment, and preliminary hearing. If charges move forward, the Common Pleas record is maintained by the Clerk of Courts and may show arraignment, motions, pleas, trial events, disposition, sentencing, and appeal activity.

Civil, Family, and Criminal Divisions

Civil matters are filed with the Prothonotary and include complaints, district judge appeals, divorces, custody cases, Protection From Abuse cases, judgments, government liens, mechanics lien waivers, and satisfactions. Criminal matters are filed with the Clerk of Courts and include motions, pleadings, transcripts, bail bond activity, criminal searches, summary appeals, and Superior Court appeals.

Family, juvenile, and Orphans' Court matters are part of the Common Pleas structure but have different access limits. Divorce is a Prothonotary civil record, while estates go through Register of Wills and Orphans' Court channels. Adoption records are impounded by law and available only by court order.

Magistrate and Lower Courts

Erie County Magisterial District Judges handle preliminary criminal proceedings, many traffic and summary offenses, landlord-tenant cases, and lower-value civil matters. MDJ dockets are searched through the UJS Magisterial District Court docket channel, and follow-up questions should go to the assigned MDJ office when the docket identifies a district.

The MDJ layer matters because many users first see a citation, landlord-tenant docket, or preliminary criminal event before the case ever reaches Common Pleas. If the UJS docket shows only an MDJ number, the assigned MDJ office is the better first contact. If a criminal matter is held for court, appealed, or otherwise moves into Common Pleas, the Clerk of Courts becomes the criminal file custodian.
